Women Of The Womb Membership - Terms & Agreements

Effective Date: February 10, 2025

This Terms & Agreements document (“Agreement”) is entered into by and between Megan Rose Healing (“Company,” “We,” “Us,” or “Our”) and you (“Member,” “You,” or “Your”). By purchasing, accessing, or participating in the Women Of The Womb Membership (“Membership”), You agree to be bound by the following terms and conditions. If You do not agree, You should not purchase or access the Membership.

1. DIGITAL PRODUCT AGREEMENT

1.1 MEMBERSHIP ACCESS & USAGE

  • The Membership is a digital, subscription-based program that grants Members access to exclusive content, teachings, practices, and resources.
  • Upon purchase, You receive access to the Membership portal for the duration of Your active subscription.
  • Access is non-transferable. Sharing login credentials or Membership content with non-members is strictly prohibited.

1.2 PAYMENTS & SUBSCRIPTION TERMS

  • Membership fees are billed automatically based on Your selected plan (monthly or annually).
  • Your subscription will renew automatically unless canceled prior to the next billing date.
  • If payment is declined, Your access will be suspended until the payment is successfully processed.

1.3 REFUND & CANCELLATION POLICY

  • All sales are final. Due to the nature of digital content, no refunds will be provided.
  • You may cancel Your Membership at any time; however, access will continue until the end of Your billing cycle, and no prorated refunds will be issued.

1.4 INTELLECTUAL PROPERTY & CONTENT USAGE

  • All Membership materials, including but not limited to videos, PDFs, meditations, and teachings, are the intellectual property of Megan Rose Healing and are protected under copyright law.
  • You may not copy, reproduce, distribute, sell, or modify any Membership content without express written permission from the Company.

2. RELEASE OF LIABILITY AGREEMENT

2.1 VOLUNTARY PARTICIPATION

  • By purchasing the Membership, You confirm that Your participation in all teachings, embodiment practices, meditations, and exercises is entirely voluntary.
  • The Membership is intended for personal development and is not a substitute for medical, psychological, or legal advice.

2.2 HEALTH & WELL-BEING DISCLAIMER

  • The Membership includes somatic practices, breathwork, and emotional healing techniques, which may elicit physical and/or emotional responses.
  • You are responsible for monitoring Your own well-being and seeking professional support if needed.
  • If You have a history of trauma, medical conditions, pregnancy, or emotional sensitivities, consult a qualified healthcare provider before engaging in Membership practices.

2.3 LIABILITY WAIVER & ASSUMPTION OF RISK

By participating in the Membership, You expressly release, waive, and discharge Megan Rose Healing from any and all:

  • Emotional, physical, or psychological responses to Membership content.
  • Injuries, discomfort, or adverse effects arising from self-guided practices.
  • Any outcomes, actual or perceived, from the application of Membership teachings.

2.4 NO MEDICAL OR MENTAL HEALTH ADVICE

  • The Membership does not provide medical diagnoses, therapy, or psychological counseling.
  • If You experience distress, discomfort, or require professional assistance, You acknowledge that You are responsible for seeking appropriate support.
  • Participation in the Membership does not establish a client-practitioner relationship with Megan Rose Healing.

2.5 INDEMNIFICATION

You agree to indemnify and hold harmless Megan Rose Healing from any claims, liabilities, damages, or disputes that arise from Your participation in the Membership.

3. TERMS OF USE

3.1 MEMBERSHIP ACCESS & ACCEPTABLE USE

  • You must be 18 years or older to participate in the Membership.
  • The Membership is for personal use only. Unauthorized sharing, distribution, or repurposing of Membership content is strictly prohibited.
  • We reserve the right to suspend or terminate access if these terms are violated.

3.2 TERMINATION OF ACCESS

Megan Rose Healing reserves the right to terminate or suspend Membership access, without refund, if:

  • You share login credentials or Membership materials.
  • You engage in disrespectful, inappropriate, or harmful conduct in community spaces.
  • You violate any other provisions outlined in this Agreement.

3.3 FORCE MAJEURE

We are not responsible for interruptions or delays in Membership access due to circumstances beyond Our control, including but not limited to:

  • Platform outages (Kajabi, Stripe, or payment gateways).
  • Natural disasters or unforeseen emergencies.
  • Technical failures or cyber-related issues.

3.4 GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Indiana, USA. Any disputes arising under this Agreement shall be resolved through mediation or arbitration prior to legal proceedings.

4. PRIVACY POLICY

4.1 INFORMATION WE COLLECT

By purchasing the Membership, We may collect:

  • Personal Details: Name, email, billing address.
  • Payment Information: Securely processed via third-party platforms (e.g., Stripe, PayPal).
  • Login Credentials: Membership access details.
  • Usage Data: Analytics on Membership engagement.

4.2 HOW WE USE YOUR INFORMATION

Your information is used for:

  • Granting Membership access.
  • Processing payments securely.
  • Sending Membership-related updates and communications.
  • Improving Membership offerings through engagement tracking.

4.3 DATA SECURITY & THIRD-PARTY SERVICES

  • We do not sell, rent, or share Your personal information for marketing purposes.
  • Secure third-party platforms (Kajabi, Stripe, PayPal) handle transactions and Membership hosting.
  • Your data may be disclosed if legally required.

4.4 COOKIES & TRACKING

  • Our website may use cookies to improve functionality and track engagement.
  • You can disable cookies via Your browser settings, though this may impact user experience.

4.5 YOUR RIGHTS & DATA CONTROL

  • Access & Corrections: You may request a copy of or corrections to Your personal data.
  • Data Deletion: You may request that Your data be deleted, subject to legal and contractual obligations.
  • Opting Out: You may unsubscribe from emails or marketing at any time.

4.6 CHANGES TO PRIVACY POLICY

We reserve the right to update this Privacy Policy at any time. Continued use of the Membership after updates constitutes acceptance of any changes.

5. AGREEMENT TO TERMS

By purchasing and accessing the Women Of The Womb Membership, You acknowledge that You have read, understood, and agreed to all terms in this Agreement.

If You do not agree to these terms, do not purchase or participate in the Membership.
